On December 29, 2025, the Supreme Court stayed the Delhi High Court’s order that had suspended the life sentence of former BJP MLA Kuldeep Singh Sengar.

This decision ensures he remains in custody while his appeal is pending.

A bench led by Chief Justice Surya Kant noted the unique circumstances, including his separate conviction.

The court issued a notice to Sengar, requiring his response within four weeks.

Background of the Case
In 2017, Sengar raped a minor girl in Unnao, Uttar Pradesh. A Delhi trial court convicted him in December 2019, imposing life imprisonment and a Rs 25 lakh fine.

Following a Supreme Court directive in August 2019, the case shifted from Uttar Pradesh to Delhi for a fair trial. Related matters, including the custodial death of the survivor’s father, were also transferred.

Delhi High Court Decision
On December 23, 2025, the Delhi High Court suspended Sengar’s sentence, citing over seven years served.

It granted conditional bail, requiring him to stay in Delhi and avoid contact with the survivor.

The court viewed him as not qualifying as a public servant for aggravated offenses under the POCSO Act. Protests erupted from the survivor, her family, and activists over safety concerns.

Survivor’s Determined Response
The survivor welcomed the Supreme Court’s stay, expressing strong faith in the judiciary. She vowed to continue her fight until Sengar receives the death penalty.

Speaking to media, she said justice for her and her late father depends on the harshest punishment. Her family highlighted ongoing needs for security and legal support.

Ongoing Legal Proceedings
The Central Bureau of Investigation challenged the suspension, arguing it overlooks the crime’s severity. The Supreme Court also directed legal aid for the survivor.

Sengar remains jailed due to a separate 10-year sentence for the father’s death. Hearings on the main appeal are expected in early 2026.
