Apex Court’s Displeasure on Protracted Adjudication
The Supreme Court of India has articulated profound discontent regarding the inordinate delays in pronouncing verdicts by various high courts across the nation. Such postponements, following the reservation of judgments, extend over months or years, thereby imperiling public confidence in the judicial apparatus.
The bench, comprising Justice Sanjay Karol and Justice Prashant Kumar Mishra, underscored that these lapses precipitate erosion of societal trust in the legal framework.
Mandated Timelines for Verdict Delivery
To mitigate these impediments, the apex court has promulgated stringent directives. Judgments reserved in any matter must be rendered within a three-month timeframe henceforth.
In instances of non-compliance, the concerned high court’s Registrar General is obligated to apprise the Chief Justice, who shall intervene to compel the bench to issue the verdict within two weeks.
Escalation Protocols for Persistent Delays
Should the stipulated period elapse without resolution, the case shall be reassigned to an alternative bench for expeditious adjudication. This mechanism aims to institutionalize accountability and preclude systemic inertia.
The directives emerged during the hearing of a 2008 criminal appeal from the Allahabad High Court, where the verdict remained pending a year post-reservation, deemed profoundly disconcerting by the bench.
Absence of Grievance Redressal Mechanisms
The Supreme Court observed that numerous high courts lack efficacious channels for litigants to lodge complaints against judgment delays, exacerbating the malaise. This deficiency perpetuates inefficiencies within the judicial hierarchy.
To address this, Registrar Generals are enjoined to furnish monthly compilations of unresolved reserved matters to their respective Chief Justices.
Nationwide Dissemination and Enforcement
The apex court has mandated circulation of its order to all high court Registrar Generals nationwide, ensuring rigorous adherence to these protocols. This initiative seeks to fortify judicial efficacy and restore institutional credibility.
