Supreme Court’s Caution
The Supreme Court warned the Election Commission of India (ECI) that any illegality in the Special Intensive Revision (SIR) of Bihar’s voter lists could lead to its complete annulment.
Justices Surya Kant and Joymalya Bagchi issued this statement while hearing petitions challenging the ECI’s voter survey process. The court has set October 7, 2025, for final arguments to determine the matter.
Confidence in ECI’s Process
The apex court noted that it presumes the ECI, a constitutional body, has followed legal guidelines in conducting the SIR.
However, it emphasized that any procedural flaws could invalidate the entire revision exercise. This ruling will have implications for voter list revisions across India.
Aadhaar’s Role in Dispute
The court recently mandated the ECI to accept Aadhaar as a valid identity document for the Bihar SIR, addressing complaints of officials rejecting it.
While clarifying that Aadhaar does not prove citizenship, the court upheld its use as proof of identity and residence. This directive followed the ECI’s objections to Aadhaar’s inclusion.
Political Allegations Surface
The opposition Congress party, led by Rahul Gandhi, has accused the ECI of manipulating voter lists in collaboration with the Bharatiya Janata Party (BJP) through the SIR, alleging “vote theft” ahead of Bihar’s elections.
Gandhi claimed similar irregularities in past elections and promised to reveal more evidence soon. These accusations have heightened scrutiny on the ECI’s actions.
